Stormstyle T And CsStormstyle.com Competition Terms and Conditions Givenchy Competition These Competition Terms and Conditions (the “Terms”) govern the competition (the “Competition”) run by Storm Model Management Limited (“we”, “us”) via the website www.stormstyle.com (the “Site”). 1. The Competition 1.1 To enter the Competition, please submit your name and email to us within the sign up form. 1.2 The submitted entries will be picked at random by an independent judge selected by FPL Ltd. 1.3 To be selected you need to get your information to us by midnight on Tuesday 16th 2008. 1.4 The winner will be contacted by Stormstyle.com via email on Wednesday 17th December 2008. 1.5 No entries will be accepted after the specified Closing Date. We reserve the right to amend the Closing Date at any time. 1.6 The Competition is free to enter and no purchase is necessary. 1.7 By entering the Competition, you signify that you have read, understand and agree to be bound by these Terms. Any entrant who does not adhere to these Terms will be disqualified. 1.8 By entering the Competition, you also signify that you have read, understand and agree to be bound by the Site’s General Terms of Use and the Privacy Policy. 2. Who is eligible to enter? 2.1 The Competition is not open to:
(a) board members, shareholders or employees of Storm Model Management Limited or Frost Publishing Limited and/or any
of their subsidiaries, holding companies or subsidiaries or such holding companies (and/or any immediate family members
of the same); and/or
(b) any other person who has been involved in organising or promoting the Competition.
2.2 Any entrant who does not own the computer from which it seeks to participate in the Competition should seek the permission of the owner of the computer before doing so. 2.3 We accept no responsibility for entries which are lost, delayed, damaged or otherwise fail to reach us. 3. Prize 3.1 The judge will choose the winning entrant will be notified by email of the judge’s decision that they have won the Competition. 3.2 The prize is non-transferable, non-negotiable and no cash alternatives will be offered. 3.3 We reserve the right to substitute the prize for another prize of comparable status. 3.4 The judge’s decision is final and no correspondence or discussion will be entered into. 3.5 The winning entrant hereby unconditionally and irrevocably authorises us to use the winning entrant’s name and age free of charge for the purposes of publicising, promoting or advertising the Site, the Competition, Storm or any other competitions, products or services provided by us or on our behalf anywhere in the world. 4. Use of personal data The personal data of each entrant will be used strictly in accordance with the Data Protection Act 1998 and we will only use any personal information that we may collect about you in accordance with our Privacy Policy. 5. Limitation of liability
5.1 Subject to 5.3, you enter the Competition at your own risk. The Site and the Competition are provided on an “as is” basis without representation or warranty of any kind, either express or implied (whether by common law, custom, statute or otherwise). To the fullest extent permitted by law, we disclaim all conditions, representations, statement and warranties (including without limitation to any implied warranty regarding the quality or the fitness for a particular purpose of the Competition or the prize). 5.2 Subject to clause 5.3, you acknowledge and agree that we shall not be liable for: (a) any direct loss, claim or damage; (b) any indirect loss, claim or damage, or any punitive, special, incidental or consequential damages of any kind that are not directly associated with the incident that caused your claim; (b) any loss of profit or savings; (c) loss or corruption of data or information; (d) loss of contracts, business or opportunity; (e) damage to goodwill or reputation(s); in each case whether direct or indirect and in each case whether based in contract, tort (including without limitation negligence), strict liability, or otherwise, arising out of or in connection with this Competition, your Materials and/or their use thereof, in each case even if we have been forewarned or are aware of the possibility of such loss or damage. 5.3 Nothing in these Terms shall exclude or limit our liability for: (a) death or personal injury caused by our negligence; or (b) any loss suffered by you as a result of your reliance on any fraudulent misrepresentation made by us to you; or (c) any liability which cannot be excluded or limited under applicable law. 5.4 You agree to indemnify, keep indemnified, defend and hold us and our parent companies, subsidiaries, affiliates and each of our respective officers, directors, employees, owners, agents, contractors, partners, information providers and licensors harmless from and against any and all claims, damages, liability, demands, losses, costs and expenses (including legal fees) (whether or not foreseeable or avoidable) incurred or suffered by any of such parties and any claims or legal proceedings which are brought or threatened arising out of or in connection with your participation or conduct in relation to the Competition and/or the prize (if applicable), your Materials, any use thereof, or any violation of these Terms or of any law or the rights of any third party. 6. General 6.1 We reserve the right, at our sole discretion, to change, modify, add, or remove portions of these Terms at any time. 6.2 If any clause or part of a clause of these Terms is, or becomes, invalid, illegal or unenforceable, then that clause or part of a clause shall be deemed to be deleted from these Terms. Any such deemed deletion shall not affect the validity, legality or enforceability of the remainder of these Terms. 6.3 The warranties, exclusions and the other express provisions of these Terms, the General Terms of Use and the Privacy Policy set out the full extent of our obligations and liabilities concerning its subject matter and supersede any previous agreements between the parties relating thereto. Subject to clause 5.3, you shall have no remedy in respect of any untrue statement made to you upon which you relied in entering into these Terms other than any remedy you may have for breach of the express terms of these Terms. 6.4 These Terms shall be governed by and construed in accordance with the laws of England and Wales and shall be subject to the exclusive jurisdiction of the English courts.
